The rules Shore Shift checks

Two rulebooks, side by side.

The words below are quoted from the law. Under each, how Shore Shift applies it. Which rules bind your business, and anything not quoted here (work permits, jobs minors may not do, pay), is for you or your adviser to confirm.

Federal 29 CFR 570.35(a), hours for minors 14 and 15 years of age (Fair Labor Standards Act child labor rules)

“(1) Outside of school hours;

(2) Not more than 40 hours in any 1 week when school is not in session;

(3) Not more than 18 hours in any 1 week when school is in session;

(4) Not more than 8 hours in any 1 day when school is not in session;

(5) Not more than 3 hours in any 1 day when school is in session, including Fridays;

(6) Between 7 a.m. and 7 p.m. in any 1 day, except during the summer (June 1 through Labor Day) when the evening hour will be 9 p.m.”

The same section defines a “week when school is in session” as any week the local public school district is in session and students must attend for at least one day or part of a day, and a “week” as the fixed workweek the employer sets.

Ohio Revised Code 4109.07, in force from October 9, 2026 (House Bill 455, 136th General Assembly)

“(A) No person under sixteen years of age shall be employed: (1) During school hours except where specifically permitted by this chapter; (2) Before seven a.m.; (3) After nine p.m. from the first day of June to the first day of September or during any school holiday of five school days or more duration; (4) After seven p.m. at any other time, except the person may be employed between seven p.m. and nine p.m. on any night preceding a day that school is not in session if the person has approval to do so from the person's parent or legal guardian; (5) For more than three hours a day in any school day; (6) For more than eighteen hours in any week while school is in session; (7) For more than eight hours in any day which is not a school day; (8) For more than forty hours in any week that school is not in session.

(C) No employer shall employ a minor more than five consecutive hours without allowing the minor a rest period of at least thirty minutes. The rest period need not be included in the computation of the number of hours worked by the minor.

(D) No person sixteen or seventeen years of age who is required to attend school under Chapter 3321. of the Revised Code shall be employed: (1) Before seven a.m. on any day that school is in session, except such person may be employed after six a.m. if the person was not employed after eight p.m. the previous night; (2) After eleven p.m. on any night preceding a day that school is in session.”

Division (B) also caps under-16s at forty hours in any one week, outside approved school work programs. Before October 9, 2026 the 7 PM limit had no parent-approval exception.

How Shore Shift applies them

Both sets, every time
Each shift for a 14- or 15-year-old is checked against the federal and the Ohio limit. When both are broken, both are listed, each with its citation. Ohio's parent-approval exception clears only the Ohio line; the federal 7 PM line still shows.
School days and school hours
You mark which days of each week school is in session and set your school's hours once. A new week starts with a guess (no school from June 1 through Labor Day and on weekends; school on other weekdays) that you change to match your district. A week with any school day counts as a week with school.
Summer dates
The federal 9 PM summer runs June 1 through Labor Day (the first Monday of September). Ohio's runs June 1 to September 1. A school break of five school days or more is marked on the week and gives Ohio's 9 PM.
Hours worked and rests
A break of 30 minutes or more with a start time is a rest: it is left out of the hours worked and ends a stretch of work. A shorter break counts as work time. Two shifts less than 30 minutes apart count as one stretch for the five-hour rest rule.
Age groups
14 or 15; 16 or 17 and required to attend school; 16 or 17 and not required to attend school; 18 or older. Ohio's division (D) applies only to the second group. Under 14 is not covered. Over 40 hours in a week for anyone 16 or older is shown as a note to check overtime pay.
The 6 AM exception for 16 and 17
A start between 6 and 7 AM on a school day passes when the board shows the person was not working after 8 PM the night before. On the first day of a week, the previous week's last day is used if it is on the board; otherwise it is marked “check”.
Nights and the end of the week
For the last day of a week, whether school is in session the next day is read from the next week if it is on the board, or from the same guess a new week starts with.

Shore Shift checks hours only. It is not legal advice, it does not know your district's calendar, and it cannot see who actually clocked in. If the board and your records differ, your records and the law win.
